1. Parties to agreement

These terms and conditions (Terms) govern your use of the Rates Assistance Application.

2. Definitions

"Act" means the Rates Act 2004.

"ACT Digital Account" means the ACT Digital Account provided by the Chief Minister, Treasury and Economic Development Directorate for the ACT Government through www.myaccount.act.gov.au.

"ACT Revenue Office" means the business unit known as the “ACT Revenue Office” within the Chief Minister, Treasury and Economic Development Directorate, an administrative unit of the Australian Capital Territory, the body politic established by section 7 of the Australian Capital Territory (Self-Government) Act 1988 (C'th).

"Deferral" means you can delay paying rates until a later date, or when the property is sold or transferred.

"Determination" means Determination for deferral of rates under the Rates Act 2004 and a Determination of amounts payable under the Taxation Administration Act 1999.

"Domestic relationship" see the Domestic Relationships Act 1994.

"Hardship deferral" means a hardship rates deferral available to home owners in the ACT who hold a current Services Australia Health Care Card or Low Income Health Care Card and others experiencing significant financial hardship.

"Notice of assessment" means a notice of assessment under the Taxation Administration Act 1999.

"Owner of a parcel of land" means the registered proprietor of an interest in the parcel (other than an interest in a lease granted by a person other than the Territory or the Commonwealth).

"Pensioner" means a person who receives a Commonwealth Government pension with entitlement  to a Pensioner Concession Card, a Department of Veterans' Affairs Pension Card, or a Department of Veterans' Affairs Veteran Gold Card.

"Principal place of residence" means the property a person primarily and lawfully occupies on an ongoing and permanent basis as the person’s usual home.

"Rates account number" means the 9-digit account number starting with 41-XXXXXXX.

"Rebate" means a reduction in your rates.

"Services Australia" refer to https://www.servicesaustralia.gov.au.

"Taxation Administration Act" means the Taxation Administration Act 1999.

"Special rate pensioner" means a pensioner who is being paid a pension under the Veterans’ Entitlements Act 1986 (Cwlth), or is being paid a special rate disability pension under the Military Rehabilitation and Compensation Act 2004 (Cwlth).

3. Access to ACT Digital Account

4. Taxpayer Obligations

You must:

  • Only use the Rates assistance form for its intended purpose, and
  • Provide information that is true and correct.

5. Security

You must:

  • report any suspicious or unauthorised use of an account to us immediately after becoming aware of it;
  • maintain the confidentiality of information and transactions contained in the ACT Digital Account at all times and in accordance with applicable requirements of the Information Privacy Act 2014; and
  • maintain the confidentiality of your username and password.

6. Change in circumstances

You must notify the ACT Revenue Office if there is a change in your circumstances within 30 days of the change. A change in circumstance when:

  • you are no longer an eligible person;
  • you are no longer an owner or a joint owner of a principal place of residence;
  • you change your principal place of residence.
