Transfer of land under Fair Work (Registered Organisations) Act 2009

Duty is not payable on the transfer of land made in accordance with the Fair Work (Registered Organisations) Act 2009(Cwlth)

Have you entered an agreement to transfer dutiable property in the ACT in accordance with the Fair Work (Registered Organisations) Act 2009 (Cwlth) - Section 82?

Section 82 - Certificates in relation to land and interests in land

Where:
(a) land or an interest in land becomes, under this division, land or an interest in land of the amalgamated organisation; and
(b) a certificate that:

(i) is signed by an authorised person
(ii) identifies the land or interest, whether by reference to a map or otherwise; and
(iii) states that the land or interest has, under this division, become land or an interest in land of amalgamated organisations;
Is lodged with the Registrar-General, Registrar of Titles or other proper officer of the State or Territory in which the land is situated.
