Lodging transactions outside the Barrier Free model

There are two categories of transactions that fall outside the Barrier Free model, dutiable transactions executed on or before 17 September 2017 and dutiable transactions executed on or after 18 September 2017 that do not affect the land titles register.

The following applies to dutiable transactions executed on or before 17 September 2017:
  • Documents must be lodged directly with our office using the following SmartForm: Lodgement of dutiable transactions executed prior to commencement of the Barrier Free Model (18 Sep 2017).
  • Online lodgements must be accompanied by any associated application for concession or exemption that was applicable at the time that the transaction was entered into, together with the relevant supporting documentation as detailed in the SmartForm.
  • In some instances printable declarations will have to be attached to the online submission.
  • Documents must be lodged and duty paid within 90 days of the contract, grant or agreement being executed, whichever is first or for an off the plan purchase agreements, within 14 days after the first of the events mentioned in section 16A of the Duties ACT 1999 or a maximum time of 1 year and 14 days after the transaction date.
  • Once your transaction is assessed for duty you will be emailed a Notice of Assessment with unique payment reference details to pay online.
  • Payment of duty must be made online using BPAY or EFT.
  • Payments can take up to 48 hours to be received and processed by our office.
  • Stamping of the dutiable instruments is required.
  • Once payment has been received by our office you can attend the Access Canberra shopfront in Dickson with your Notice of Assessment and applicable document (i.e. contract and transfer instrument) to have them stamped.
  • You will then be able to proceed to settlement with your stamped documents to complete your property purchase.
The following applies to dutiable transactions executed on or after 18 September 2017 that do not affect the land titles register:
  • Documents must be lodged directly with our office using the applicable SmartForm for your transaction.
  • Online lodgements must be accompanied by any associated application for concession or exemption and relevant supporting documentation as detailed in the SmartForm.
  • In some instances printable declarations will have to be attached to the online submission.
  • Documents must be lodged and duty paid within 90 days of the contract, grant or agreement being executed, whichever is first.
  • Once your transaction is assessed for duty you will be emailed a Notice of Assessment with unique payment reference details to pay online.
  • Payment of duty must be made online using BPAY or EFT.
  • Payments can take up to 48 hours to be received and processed by our office.
